Luigi Mangione, the 28-year-old accused of fatally shooting UnitedHealthcare executive Brian Thompson in Manhattan in December 2024, is temporarily withdrawing plans to introduce evidence that he was suffering an extreme mental health crisis at the time of the alleged killing, according to a court filing submitted Friday.
Mangione’s legal team told the court that they are “at this time” stepping back from a strategy that would have relied on New York’s “extreme emotional disturbance” defense, which can reduce a murder charge to manslaughter if a jury accepts that the defendant was under severe psychological stress.
Mangione has pleaded not guilty to state murder, weapons, and forgery charges filed by Manhattan District Attorney Alvin Bragg. His state trial is scheduled for September before Justice Gregory Carro in Manhattan.
Under New York law, the extreme emotional disturbance argument does not negate guilt but can significantly reduce sentencing exposure by lowering the severity of the conviction. However, legal experts note it is often difficult to establish in cases where prosecutors allege premeditation and post-crime evasion.
In a separate federal case, Mangione has also pleaded not guilty to murder, weapons, and stalking charges brought by Manhattan federal prosecutors. Some earlier charges were dismissed on procedural grounds in January, removing the possibility of the death penalty, though he still faces potential life imprisonment if convicted of stalking-related offenses.
Mangione’s case, which stems from the killing of Brian Thompson during an investor conference stay at a Midtown hotel, drew widespread public attention and became a focal point in broader debates about healthcare costs and the insurance industry.
Jury selection in the federal case is expected to begin in September, with opening statements scheduled for November.
