HSBC Holdings is facing legal action in Australia after regulators alleged “widespread and systemic failures” in its anti-scam controls, marking one of the first major cases globally focused specifically on banks’ responsibility for protecting customers from fraud.
The case, brought by the Australian Securities and Investments Commission (ASIC), claims HSBC’s internal systems had inadequate safeguards and failed to respond promptly to customer complaints, leaving clients vulnerable to scams and resulting in substantial financial losses. ASIC Chair Sarah Court said the alleged failures resulted in “tens of millions of dollars out of pocket” for customers and highlighted delays in resolving fraud cases, in some instances taking months for victims to understand what had happened to their funds.
HSBC has now accepted fault after initially signaling it would contest the proceedings. The regulator also noted that the bank had already paid around AUD $28 million in refunds and compensation. The case includes examples of individuals losing large portions of their savings, including a dental technician who lost nearly AUD $47,000, and other customers who lost between $48,000 and $50,000 in separate incidents.
The Australian action adds to a long history of regulatory penalties against HSBC across multiple jurisdictions. The bank has previously faced fines for anti-money laundering failures, including a £57.4 million penalty from the Bank of England in 2024, a £64 million UK fine in 2021, and a £6.3 million penalty in 2024 for mishandling loan customers in arrears. Its most significant penalty came in 2012, when it paid $1.9 billion to U.S. authorities over anti-money laundering lapses linked to drug cartels. The latest case underscores increasing global regulatory pressure on banks to strengthen fraud prevention systems and take greater responsibility for protecting retail customers in an environment of rising digital financial crime.
