Italian utility giant Enel has formally requested a technical expert examination in a regulatory proceeding that could ultimately threaten its electricity distribution concession in São Paulo, Brazil.
The filing was submitted to Brazil’s energy regulator, Aneel, late Wednesday as part of an investigation launched in early April following repeated service failures and widespread criticism over power outages affecting consumers.
At the center of the dispute is Enel’s handling of electricity restoration efforts after severe weather events struck the São Paulo region. Aneel and Enel disagree over whether the company responded adequately and whether its operational performance met regulatory expectations during the emergencies.
Enel Challenges Regulatory Assessment
In its filing, Enel proposed the creation of a jointly selected multidisciplinary technical team to analyze several factors related to the outages, including:

The company argues that extraordinary climate events should be evaluated differently from routine operational failures.
Enel also renewed its request to annul the proceeding entirely, claiming that its concession agreement does not contain clearly defined performance metrics for restoring service during extreme weather emergencies.
According to the company, current regulations fail to adequately account for the scale and unpredictability of severe climate-related disruptions.
Pressure Mounts After Repeated Outages
The dispute comes after mounting public and political pressure in Brazil over repeated blackouts and delayed restoration times in São Paulo, one of the largest urban areas in the world.
