Kerala MLA Rahul Mamkootathil Booked on Multiple Serious Charges, Including Rape and Forced Abortion

Kerala MLA Rahul Mamkootathil has been booked under multiple non-bailable sections of the Bharatiya Nyaya Sanhita (BNS) 2023, following allegations of rape, criminal intimidation, and coerced abortion. His close associate Joby Joseph has been named as the second accused in the FIR, according to reports from ANI.

The FIR states that the survivor was allegedly sexually assaulted by Rahul on March 4 at her flat in Thrikkannapuram, Thiruvananthapuram. The complaint notes that he allegedly forced her into sexual intercourse and later threatened her to ensure silence.

The allegations further detail a second incident on March 17, where Rahul reportedly recorded nude videos of the survivor without her consent. The FIR mentions that he warned her he would “destroy her life” if she disclosed their relationship.

The survivor told police that despite knowing she was pregnant, Rahul allegedly raped her again on April 22, and later for two days in May at the MLA’s Build Tech Summit flat in Palakkad.

The second accused, Joby Joseph, allegedly collected the survivor from Kaimanam on May 30, during which he gave her abortion pills while driving. According to the FIR, Rahul then forced her to take the pills, resulting in an induced abortion, followed by further threats to prevent disclosure of the incident.

Police fast-tracked the investigation after the survivor and her family met Chief Minister Pinarayi Vijayan on November 27 at the Secretariat. The FIR, initially lodged at the Nedumangad Valiyamala Police Station, was later transferred to Nemom Police Station, as the alleged incidents occurred within its jurisdiction.

Meanwhile, tight security has been deployed at the MLA’s residence in Adoor, Pathanamthitta district, with police personnel stationed in and around the premises as a precautionary measure.

The FIR has been registered under eight non-bailable sections of BNS 2023, including:

  • Section 64 – Rape
  • Section 64(2) – Repeated rape on the same woman
  • Section 64(f) – Rape by a person in a position of trust
  • Section 64(h) – Rape on a pregnant woman
  • Section 64(m) – Repeated rape
  • Section 89 – Causing miscarriage without a woman's consent
  • Section 316 – Criminal breach of trust
  • Section 68(e) of the IT Act – Transmission of offensive digital content

The offences carry penalties ranging from 10 years’ imprisonment to life imprisonment.

Police have stated that the investigation is ongoing, based on the detailed complaint submitted by the survivor.
